Public offer for services

This document is a public offer under articles 435 and 437 of the Civil Code of the Russian Federation: a proposal to enter into a contract for the provision of services for a fee, on the terms set out below. It is addressed to any individual with legal capacity and to any legal entity.

The contract is concluded at the moment of payment. No paper document is needed: paying through the form on batmeleh.com is itself acceptance of this offer.

The Provider may change these terms. A new version takes effect on the date it is published on this page. Services already paid for are governed by the version in force on the day of payment.

The Provider is Individual entrepreneur Shepitko Mariia Mikhailovna (the “Provider”), the owner of the site batmeleh.com.

The Customer is a person who has paid for the services on the terms of this offer.

The Provider supplies information and educational services: it prepares and publishes material on Jewish tradition, family life and the life of a woman — articles, audio recordings, video lectures, commentaries on the weekly Torah portion — and keeps the Customer informed through a newsletter and announcements of the project's meetings and classes.

The service is provided remotely, through the site batmeleh.com and the email address given by the Customer.

The service is treated as rendered as material is published and information messages are sent. The parties draw up no completion certificates: the contract is performed at the moment access to the portal's material is provided.

The Customer sets the price: in the form on the home page you pick one of the suggested amounts or enter your own. The minimum single payment is 10 ₽; the currency is the Russian rouble.

Payment is made by bank card on the acquiring bank's secure payment page. Card details are entered only there. The site batmeleh.com never sees and never stores the card number, its expiry date or the security code — they are processed by the bank in accordance with the requirements of the international payment systems.

The “Monthly subscription” tick box expresses an intention to pay regularly. No automatic charge is made to the card on the strength of that tick: each further payment is made by the Customer. Should automatic charging ever be introduced, it will be stated plainly here and separate consent will be requested.

For every payment the Provider issues a fiscal receipt in accordance with Federal Law No. 54-FZ of 22 May 2003 and sends it electronically to the email address given by the Customer at the time of payment.

No paper receipt is issued: the settlement is remote, without direct interaction between the parties. An electronic receipt has the same force as a paper one.

If the receipt has not arrived within a day, check the spam folder and then write to batmelekh@yandex.com — the Provider will send it again.

The contract is concluded at the moment the money is credited to the Provider's account.

By paying, the Customer confirms that they have read this offer and agree with it, that they act voluntarily and in their own interest, and that the money belongs to them lawfully.

The Customer may withdraw from the services at any time and ask for a refund (article 782 of the Civil Code of the Russian Federation and article 32 of the Consumer Rights Protection Act). The Provider refunds the money less costs actually incurred.

The money is refunded in full, without any deduction, in two cases:

• the payment was made by mistake — the wrong amount, an accidental second click;
• the payment was made without the knowledge of the cardholder.

To request a refund, write to batmelekh@yandex.com from the address given when paying and state the date, the amount and the last four digits of the card. Requests are accepted within 30 calendar days of the payment. The money is returned to the same card within 10 working days of the Provider confirming the refund; when it actually arrives depends on the Customer's bank. A refund receipt is issued.

The Customer's name and email address are processed in order to provide the service, send the fiscal receipt, answer enquiries and comply with accounting, tax and cash-register legislation.

The details are in the privacy policy and the consent to personal data processing. By submitting the form the Customer accepts their terms.

The Provider does not guarantee uninterrupted operation of the site: maintenance breaks and connection failures are possible. Such breaks do not count as failure to provide the service, provided the material remains available within a reasonable time.

Anything not covered by this offer is governed by the law of the Russian Federation. The parties will try to settle disputes by correspondence; failing that, in the manner established by law.

If any provision of this offer proves invalid, the remaining provisions stay in force.
